2.2 All laboratory tests are performed solely by Diagnostics (Dx) Your Way Laboratory, an independent third-party laboratory. ASHA is not a healthcare provider and does not conduct testing, generate results, provide medical diagnosis, or have any control over the Laboratory’s testing procedures, accuracy, or results. Any questions or concerns regarding test results, accuracy, or Laboratory services should be directed to Diagnostics (Dx) Your Way Laboratory.
2.3 The Services are not appropriate for urgent or emergency medical situations. If you believe you may be experiencing a medical emergency, call 911 or go to the nearest emergency department.
3.1 ASHA facilitates ordering, payment, and logistics for STI testing.
3.2 The Diagnostics (Dx) Your Way Laboratory fulfills test orders, provides kits, processes specimens, and delivers results.
3.3 The Diagnostics (Dx) Your Way Laboratory may refer you for follow-up care. ASHA does not provide healthcare services or treatment.
4.1 You must be at least 18 years of age and legally capable of entering into binding contracts under applicable law to use the Site or Services. By using the Site, you represent and warrant that you meet these eligibility requirements and that all information you provide is accurate and complete. ASHA reserves the right to verify your age and identity and to refuse or terminate service to anyone who does not meet these requirements.
4.2 If you order Services for another person, you represent and warrant that you have lawful authority and that person’s informed consent to do so, and that you have provided them with a copy of these Terms and our Privacy Policy.
5.1 Services require you to create a user account. You agree to provide accurate, current, and complete information.
5.2 You are responsible for maintaining the confidentiality of your login credentials and for submitting accurate information.
5.3 You must notify ASHA immediately of any unauthorized use or breach of security of your account.
6.1 All fees are due at the time of purchase and are listed in U.S. dollars. Prices may change without notice.
6.2 Due to the nature of medical testing products, test kits cannot be returned or refunded once shipped for health, safety, and regulatory reasons, except in cases of defective or damaged kits received by you. In the event you receive a defective or damaged kit, you must contact Diagnostics (Dx) Your Way Laboratory at info@dxyourway.com within seven (7) days of receipt to request a replacement. This no-return policy does not affect your rights under applicable consumer protection laws.
6.3 You are responsible for providing accurate shipping information, and ASHA is not liable for delays or non-delivery resulting from incorrect addresses.
7.1 ASHA collects limited personal information to process your order.
7.2 Test results and related medical data are managed solely by Diagnostics (Dx) Your Way Laboratory, which is a HIPAA covered entity subject to HIPAA compliance obligations. The Laboratory’s privacy practices are governed by their Notice of Privacy Practices, available at https://dxyourway.com/privacy-policy/. ASHA is not a HIPAA covered entity with respect to your test results and does not have access to your medical test results or protected health information maintained by the Laboratory. For questions about how the Laboratory uses or discloses your health information, please review their privacy notice or contact them directly at info@dxyourway.com.
7.3 By using the Services, you expressly authorize and consent to ASHA sharing necessary information (including but not limited to your name, contact information, demographic information, and order details with Diagnostics (Dx) Your Way Laboratory for testing and service delivery purposes and with public health partners that sponsor or support the Services for public health reporting, disease surveillance, and program evaluation purposes as required or permitted by law. Any such sharing will be conducted in accordance with applicable federal and state privacy laws, including HIPAA where applicable. You may withdraw this authorization at any time by contacting us at info@ashasexualhealth.org, but withdrawal will not affect information already shared and may prevent us from providing Services to you.
8.1 By using the Site and providing your contact information, you expressly consent to receive communications from ASHA and/or Diagnostics (Dx) Your Way Laboratory by phone (including calls to any mobile number you provide, which may be made using an automatic telephone dialing system or prerecorded voice), email, text message (SMS/MMS), or mail regarding your Services, including order confirmations, shipping notifications, test result availability, and other transactional or service-related messages. You understand that message and data rates may apply to text messages, and you are responsible for such charges. You may opt out of certain communications as described in Section 8.2, but you may not opt out of essential service-related communications.
8.2 You may opt out of non-essential promotional communications at any time by contacting us at info@ashasexualhealth.org or by following the unsubscribe instructions in our emails. Please note that you may not opt out of communications related to your orders or Services.

ASHA does not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.
You agree to indemnify, defend, and hold harmless ASHA, its affiliates, directors, officers, employees, agents, and partners from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from: (a) your use of the Site or Services; (b) your violation of these Terms; (c) your violation of any applicable law; or (d) your infringement of any third-party rights.
16.1 ASHA is not responsible for Diagnostics (Dx) Your Way Laboratory’s performance, test accuracy, or your reliance on your test results.
16.2 To the fullest extent permitted by applicable law, in no event shall ASHA, its directors, officers, employees, agents, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising from your use of, or inability to use, the Site or Services.
16.3 In no event shall ASHA’s total aggregate liability exceed the greater of (a) the amount you paid for the Services giving rise to the claim during the twelve (12) months preceding the claim, or (b) one hundred dollars ($100.00).
17.1 The Site may contain links to websites operated by third parties. ASHA does not endorse and is not responsible for the content, accuracy, privacy practices, or use of such third-party sites.

18.1 These Terms are governed by and construed in accordance with the laws of the State of North Carolina, United States, without regard to its conflict of law principles.
18.2 Any dispute arising out of or relating to these Terms or the Site will be resolved by binding arbitration administered by the American Arbitration Association in accordance with its Consumer Arbitration Rules. The arbitration will take place in Wake County, North Carolina, or at another location mutually agreed upon by the parties. Each party shall bear its own costs of arbitration, except that ASHA shall pay the arbitration filing fees for claims brought by consumers. Exceptions to arbitration include: (a) claims that qualify for small claims court jurisdiction; and (b) actions seeking equitable relief to protect intellectual property rights.
18.3 BY AGREEING TO ARBITRATION, YOU WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN CLASS ACTIONS, CLASS ARBITRATIONS, OR REPRESENTATIVE ACTIONS. If this class action waiver is found to be unenforceable, then the entirety of this arbitration agreement shall be null and void. You have the right to opt out of this arbitration agreement by sending written notice to ASHA at the address listed in Section 26 within thirty (30) days of first accepting these Terms.
ASHA may suspend or terminate your access to the Site or Services at any time for cause, including violation of these Terms. Provisions of these Terms that by their nature should survive termination will survive, including ownership provisions, warranty disclaimers, indemnification obligations, limitations of liability, and dispute resolution provisions.
20.1 Failure to enforce any provision of these Terms does not constitute a waiver of that provision.
20.2 If any provision is held invalid, the remaining provisions will remain in full force and effect.
These Terms constitute the entire agreement between you and ASHA regarding your use of the Site and Services.
ASHA shall not be liable for any failure or delay in performing its obligations where such failure or delay results from circumstances beyond ASHA’s reasonable control, including but not limited to natural disasters, pandemics, government actions, labor disputes, or disruptions to telecommunications or supply chains.
You may not assign or transfer your rights or obligations under these Terms without ASHA’s prior written consent. ASHA may assign its rights and obligations under these Terms without restriction.
